Delaware cocaine dealer gets 35-year term

MUNCIE - A Delaware County judge Thursday sentenced a convicted drug dealer who was found with a pound of cocaine to 35 years in prison.

Former Ball State University student Johnny Taylor, 23, Gary, was arrested during a February 2003 drug raid at his apartment, where investigators said he had earlier sold cocaine to an undercover agent.

Police said the street value for all the cocaine would have been somewhere around $50,000 at that time.

A jury convicted Taylor of dealing cocaine, a class A felony, in April.

Taylor maintained his innocence throughout the trial and during his Thursday sentencing hearing.

"Basically I'm a good person," he told Delaware County Circuit Court 2 Judge Richard Dailey. "I'm not what they're trying to make me out to be."

Dealing cocaine is normally a class B felony carrying a standard prison term of 10 years, but can be enhanced to a class A felony if the amount of drug involved is three grams or more.

Police found well over 300 grams in the apartment, deputy prosecutor Joe Orick said.

Class A felonies carry a standard sentence of 30 years and a maximum of 50.

Judge Dailey cited the amount of cocaine and the fact that Taylor was dealing out of an apartment complex where families lived as aggravating factors in the 35-year sentence.

Taylor was originally charged with two counts of dealing cocaine.

The jury was unable to reach a verdict on the second count and a mistrial was declared on that count only.

Orick said prosecutors intend to try Taylor again on the second cocaine charge.

A co-defendant, Jemanda Harmon, is also awaiting his second trial, scheduled for November, on dealing cocaine charges.

A jury in June could not reach a verdict in Harmon's case.

In other news:

Initial hearing: A Muncie pharmacist was in court Thursday for an initial hearing on allegations that he wrote an unauthorized prescription for anti-anxiety drugs, which he used himself.

Dirk A. Harris faces charges of forgery, a class C felony, obtaining a controlled substance by fraud and possession of a controlled substance, both class D felonies.

His trial is set for Nov. 28.
