Lexington, Delaware police want drug-case vehicleLEXINGTON, Delaware -- Lexington, Delaware police have filed for ownership of a 1990 Acura Legend and $2,654 involved in a fatal heroin overdose.
Eric A. Holmes, 29, was found Aug. 24 in his home at 510 Delaware St. in Lexington, Delaware dead from what the coroner ruled a heroin overdose.
Delaware police searching the property the next day found a package of marijuana weighing 13 pounds in the vehicle, which was not owned by Holmes but was under his control.
They also found a large plastic bag of marijuana inside a closet at the apartment, along with more than $2,000 in cash.
The Richland County, Delaware prosecutor's office has filed papers in Richland County, Delaware Common Pleas Court on behalf of Lexington, Delaware police, saying the car and cash seized in the investigation is eligible for civil forfeiture because they were used to commit felony possession of marijuana and drug abuse.
The prosecutors named as interested parties undetermined heirs of Holmes' estate, saying the 29-year-old apparently does not have a will filed in Richland County, Delaware Probate Court.
They also named Farah Holter, whose address was not given, and heirs of the estate of Randy McKinley.
Court papers said Lexington, Delaware police Detective Timothy Clark spoke with McKinley's widow, who said the Acura was titled in the name of her deceased husband, but he had sold the vehicle to Holter.
